共同担保内部追偿问题的法律逻辑与制度完善

摘要：
共同担保是从法定或约定的角度对同一债权设立复数担保的一种方式，它是经济发展和交易规则过程完善中的必然选择。在《最高人民法院关于适用〈中华人民共和国民法典〉有关担保制度的解释》中，并没有明确共同担保内部追偿的各项内容，这导致在执行过程中，会出现担保人内部追偿权行使的模糊混乱问题。以共同担保内部追偿为研究对象，阐述其正当性，梳理内部追偿的具体情形，并从份额分担、价值确定、权利行使等维度，详细探讨完善共同担保内部追偿权行使规则的方法。这不仅能够为立法和司法实践提供有益的思考方向，还能提升共同担保内部追偿处理的公正性，促进担保法律制度的完善。
Legal logic and System Perfection of Internal Recovery of Joint Guarantee

Abstract:
Co-guarantee is a way to set up multiple guarantees for the same creditor’s rights from the legal or agreed point of view. It is an inevitable choice in the process of economic development and improvement of trading rules. In Provisions of the Supreme People’s Court on the Application of the Guarantee System in the Civil Code of People’s Republic of China, the contents of internal recourse of joint guarantee are not clearly defined, which leads to the vague and chaotic exercise of the guarantor’s internal recourse right in the implementation process. Taking the internal recourse of joint guarantee as the research object, the study expounds its legitimacy, combs the specific situation of internal recourse, and discusses in detail the methods to improve the rules for exercising the internal recourse of joint guarantee from the dimensions of share sharing, value determination and right exercise. This can not only provide a useful thinking direction for legislation and judicial practice, but also improve the fairness of internal recovery treatment of joint guarantee and promote the perfection of guarantee legal system.
